This Acceptable Use Policy (“AUP”) governs use of the VoltFax™ services, website, applications, APIs, software, fax numbers, and related services (collectively, the “Service”).

VoltFax™ is a brand operated by BWN Ventures, LLC, a California limited liability company (“VoltFax,” “Company,” “we,” “us,” or “our”).

This AUP forms part of the VoltFax Terms of Service and applies to all users, customers, administrators, team members, and account holders.

By using the Service, you agree to comply with this AUP.


1. Purpose

VoltFax is intended for lawful business and personal communications.

Users must use the Service responsibly, lawfully, and in a manner that does not interfere with the rights of others, the operation of the Service, telecommunications networks, infrastructure providers, or third parties.


2. Compliance with Laws

You are solely responsible for ensuring that your use of the Service complies with all applicable laws, regulations, court orders, industry requirements, and governmental rules, including those relating to:

  • privacy;
  • healthcare;
  • telecommunications;
  • marketing;
  • advertising;
  • consumer protection;
  • intellectual property;
  • records retention;
  • data protection;
  • export controls;
  • sanctions laws.

VoltFax does not provide legal, compliance, or regulatory advice.


3. Prohibited Activities

You may not use the Service to engage in, facilitate, promote, support, or distribute any activity that is unlawful, harmful, fraudulent, abusive, deceptive, or otherwise prohibited.

Prohibited activities include, without limitation:

  • violating any law or regulation;
  • infringing intellectual property rights;
  • violating privacy rights;
  • violating contractual obligations;
  • engaging in fraud or misrepresentation;
  • impersonating another person or entity;
  • identity theft;
  • document forgery;
  • falsifying sender information;
  • transmitting deceptive or misleading communications;
  • circumventing legal requirements;
  • facilitating illegal transactions;
  • facilitating unlawful business activities.

4. Fax Spam and Unsolicited Communications

You may not use the Service to send:

  • unsolicited fax advertisements;
  • unlawful marketing communications;
  • junk faxes;
  • mass unsolicited communications;
  • spam;
  • bulk messages that violate applicable law.

Users are responsible for obtaining all legally required consents and permissions before transmitting communications.

VoltFax may suspend or terminate accounts involved in suspected spam activity.


5. Fraudulent and Deceptive Conduct

You may not use the Service to:

  • conduct scams;
  • commit fraud;
  • engage in phishing;
  • impersonate organizations;
  • impersonate government agencies;
  • impersonate healthcare providers;
  • impersonate financial institutions;
  • transmit forged documents;
  • distribute false records;
  • deceive recipients regarding the origin or authenticity of communications.

6. Illegal Content

You may not use the Service to create, store, transmit, receive, distribute, promote, or facilitate content that:

  • violates law;
  • promotes criminal activity;
  • facilitates fraud;
  • contains child sexual abuse material;
  • contains unlawful exploitation material;
  • promotes human trafficking;
  • promotes violence where unlawful;
  • violates intellectual property rights;
  • violates privacy rights.

VoltFax reserves the right to immediately report apparent violations to appropriate authorities.


7. Malware and Security Violations

You may not use the Service to:

  • distribute malware;
  • distribute ransomware;
  • distribute viruses;
  • distribute malicious code;
  • distribute spyware;
  • distribute trojans;
  • distribute harmful scripts;
  • conduct security attacks;
  • attempt unauthorized access;
  • interfere with networks or systems;
  • bypass security controls.

8. Unauthorized Access

You may not:

  • access accounts that do not belong to you;
  • attempt to obtain credentials;
  • circumvent authentication systems;
  • bypass access restrictions;
  • exploit vulnerabilities;
  • probe or scan systems without authorization.

9. Interference with the Service

You may not:

  • interfere with Service operations;
  • overload infrastructure;
  • degrade network performance;
  • disrupt other customers;
  • conduct denial-of-service attacks;
  • abuse APIs;
  • automate activity in a manner that harms Service stability.

10. Excessive or Abusive Usage

The Service is intended for normal business and personal fax usage.

VoltFax may restrict, throttle, suspend, investigate, or terminate accounts exhibiting excessive, abnormal, suspicious, abusive, automated, or operationally burdensome usage.

VoltFax reserves sole discretion in determining whether activity is excessive or abusive.


11. Healthcare and Regulated Information

Customers transmitting healthcare information remain solely responsible for compliance with:

  • HIPAA;
  • HITECH;
  • state privacy laws;
  • healthcare regulations;
  • professional obligations.

Customers may not represent that VoltFax is HIPAA compliant or acting as a Business Associate unless a valid Business Associate Agreement has been executed.


12. Intellectual Property Rights

You may not use the Service to:

  • infringe copyrights;
  • infringe trademarks;
  • infringe trade secrets;
  • violate proprietary rights;
  • distribute unauthorized copies of protected works.

Users remain solely responsible for the content they transmit.


13. High-Risk Activities

VoltFax is not intended for activities where transmission failures could reasonably be expected to result in:

  • death;
  • bodily injury;
  • emergency response failures;
  • critical healthcare decisions;
  • aviation operations;
  • nuclear operations;
  • weapons systems;
  • life-support systems.

You may not rely on the Service for such purposes.


14. Investigations

VoltFax may investigate suspected violations of this AUP, the Terms of Service, applicable law, or other Company policies.

Investigations may include:

  • review of account activity;
  • review of usage patterns;
  • review of transmission metadata;
  • review of billing activity;
  • review of security information;
  • cooperation with service providers.

Nothing in this section obligates VoltFax to monitor customer activity.


15. Cooperation with Authorities

VoltFax may disclose information and cooperate with:

  • courts;
  • law enforcement agencies;
  • regulatory agencies;
  • governmental authorities;
  • telecommunications providers;
  • service providers;

when VoltFax believes such disclosure is appropriate, necessary, or legally required.


16. Enforcement

VoltFax may take any action it determines appropriate, including:

  • warnings;
  • account restrictions;
  • temporary suspension;
  • permanent suspension;
  • termination;
  • blocking transmissions;
  • disabling fax numbers;
  • removing content;
  • refusing service;
  • reporting violations.

VoltFax may act with or without prior notice.


17. No Obligation to Monitor

VoltFax has no obligation to monitor customer activity, content, or communications.

Failure to enforce any provision of this AUP shall not constitute a waiver of any rights.


18. Updates

VoltFax may modify this AUP at any time.

Updated versions become effective upon posting unless otherwise stated.

Continued use of the Service constitutes acceptance of the updated AUP.
