Service Limitations

This Service Limitations Policy describes important limitations, restrictions, and operational characteristics of the VoltFax™ services, website, applications, APIs, software, fax numbers, and related services (collectively, the “Service”).

VoltFax™ is a brand operated by BWN Ventures, LLC, a California limited liability company (“VoltFax,” “Company,” “we,” “us,” or “our”).

This Policy forms part of the VoltFax Terms of Service.

By using the Service, you acknowledge and accept the limitations described below.


1. No Guarantee of Delivery

VoltFax attempts to facilitate the transmission and receipt of fax communications through various telecommunications networks, communications providers, internet services, and infrastructure providers.

VoltFax does not guarantee:

  • successful transmission;
  • successful receipt;
  • successful routing;
  • delivery timing;
  • transmission speed;
  • uninterrupted processing;
  • successful delivery to any recipient.

A fax may fail for reasons including:

  • busy signals;
  • recipient equipment failures;
  • recipient configuration issues;
  • incorrect fax numbers;
  • carrier issues;
  • telecommunications failures;
  • internet outages;
  • service provider interruptions;
  • security filtering;
  • technical errors;
  • force majeure events.

Customers remain solely responsible for confirming successful delivery whenever delivery confirmation is important.


2. Transmission Confirmations

Delivery confirmations, status reports, logs, activity records, and transmission notifications are provided for informational purposes only.

A transmission confirmation does not guarantee that:

  • the recipient received the document;
  • the recipient reviewed the document;
  • the recipient processed the document;
  • the recipient acted upon the document;
  • the transmission was error-free.

Customers remain responsible for independently verifying receipt when necessary.


3. No Uptime Guarantee

Unless otherwise expressly stated in a separate written agreement signed by VoltFax, the Service is provided on an “as available” basis.

VoltFax does not guarantee:

  • continuous availability;
  • uninterrupted operation;
  • specific uptime levels;
  • fault-free operation.

Maintenance, upgrades, security measures, third-party outages, and unforeseen events may affect availability.


4. No Service Level Agreement

VoltFax does not provide a Service Level Agreement (“SLA”) unless expressly stated in a separate written agreement executed by VoltFax.

No credits, refunds, penalties, or compensation are owed for downtime, interruptions, delays, or service degradation unless required by law or specifically agreed in writing.


5. Telecommunications and Third-Party Dependencies

The Service depends upon third-party providers, including but not limited to:

  • telecommunications networks;
  • communications providers;
  • cloud infrastructure providers;
  • internet service providers;
  • authentication providers;
  • email providers;
  • payment processors;
  • security providers.

VoltFax does not control the operations of such providers.

Performance of the Service may be affected by failures, delays, interruptions, restrictions, maintenance, or decisions made by third parties.


6. Email Delivery Limitations

Email-to-fax and fax-to-email functionality relies upon third-party email systems and internet infrastructure.

VoltFax does not guarantee:

  • email delivery;
  • email receipt;
  • inbox placement;
  • spam filter avoidance;
  • delivery timing.

Messages may be delayed, rejected, filtered, blocked, quarantined, or lost by third-party systems.


7. File Compatibility Limitations

VoltFax supports certain document formats and file types.

Not all file types, document structures, fonts, images, layouts, embedded content, or formatting may be rendered correctly.

Documents may experience:

  • formatting changes;
  • conversion issues;
  • image degradation;
  • font substitutions;
  • page layout differences;
  • transmission artifacts.

Customers are responsible for reviewing documents before transmission.


8. Fax Number Availability

Availability of local, toll-free, and other fax numbers depends upon third-party providers and regulatory requirements.

VoltFax does not guarantee:

  • availability of specific numbers;
  • availability within a particular area code;
  • availability of number porting;
  • continued availability of assigned numbers.

Assigned numbers may be changed, suspended, reclaimed, discontinued, or reassigned when reasonably necessary.


9. Number Porting Limitations

Where offered, fax number porting is subject to:

  • third-party carrier requirements;
  • regulatory requirements;
  • provider approval;
  • account verification.

VoltFax does not guarantee successful completion of any port request.

Porting delays may occur.

Temporary service interruptions may occur during porting.


10. Storage Limitations

Storage capacity may vary based on subscription plan.

VoltFax may impose limits on:

  • storage volume;
  • document retention;
  • attachment size;
  • transmission size;
  • account activity.

VoltFax is not an archival or records-retention service.

Customers are responsible for maintaining independent backups.


11. Security Limitations

VoltFax employs security measures designed to help protect information.

However, no system, network, platform, communication method, or security control can guarantee complete security.

VoltFax cannot guarantee that unauthorized access, disclosure, alteration, destruction, loss, or misuse of information will never occur.

Customers assume these inherent risks when using the Service.


12. HIPAA and Regulatory Compliance Limitations

Certain subscription plans may be designated as HIPAA-ready or HIPAA-eligible.

HIPAA-related protections apply only where:

  1. a HIPAA-eligible plan is purchased;
  2. VoltFax offers HIPAA services for that plan; and
  3. a valid Business Associate Agreement has been executed.

Customers remain solely responsible for determining whether use of the Service satisfies:

  • HIPAA requirements;
  • HITECH requirements;
  • healthcare regulations;
  • legal obligations;
  • professional obligations;
  • record retention requirements.

VoltFax does not provide legal, compliance, or regulatory advice.


13. No Legal Filing Guarantee

VoltFax does not guarantee acceptance of documents by:

  • courts;
  • government agencies;
  • regulators;
  • healthcare organizations;
  • insurance companies;
  • third parties.

Customers remain solely responsible for confirming filing requirements, submission requirements, and receipt requirements.


14. No Emergency Services

The Service is not designed, intended, or guaranteed for emergency communications.

Customers must not rely on the Service for:

  • emergency notifications;
  • emergency response;
  • public safety communications;
  • medical emergencies;
  • law enforcement emergencies;
  • fire emergencies;
  • life-safety situations.

Alternative communication methods should always be available.


15. High-Risk Activities

The Service is not intended for activities where service failures could reasonably be expected to result in:

  • death;
  • bodily injury;
  • emergency response failures;
  • critical healthcare outcomes;
  • aviation incidents;
  • nuclear incidents;
  • weapons systems failures;
  • life-support system failures.

Customers use the Service for such activities entirely at their own risk.


16. Geographic Availability

Availability of the Service may vary by:

  • country;
  • region;
  • telecommunications provider;
  • regulatory requirements;
  • local restrictions.

VoltFax may restrict, suspend, or discontinue service in certain jurisdictions.


17. Planned Maintenance

VoltFax may perform maintenance, upgrades, testing, security updates, migrations, or infrastructure changes.

Such activities may temporarily affect availability or performance.

Advance notice may not always be possible.


18. Future Features

VoltFax may modify, suspend, discontinue, replace, or remove features, functionality, integrations, APIs, pricing, plans, or service offerings at any time.

Nothing in the Service creates an obligation to continue offering any specific feature or functionality.


19. Updates

VoltFax may update this Service Limitations Policy from time to time.

Updated versions become effective upon posting unless otherwise stated.

Continued use of the Service constitutes acceptance of any updated version.
